1. Introduction.
Welcome to Savara Luxe Safari. By booking a safari with us, you agree to adhere to the following terms and conditions, which constitute a legally binding contract between you (the client) and Savara Luxe Safari (the Company). 2. Reservations and Payments.
BOOKING CONFIRMATION: A 30% deposit of the total safari cost is required to confirm your reservation. This deposit must be paid within seven (7) days of receiving the booking invoice. Failure to pay the deposit within this period may result in cancellation of the reservation.
FINAL PAYMENT: The remaining balance is due no later than 60 days before the safari commencement date. If the booking is made within 60 days of the safari start date, full payment is required immediately upon confirmation.
PAYMENT METHODS: Payments may be made via bank transfer, credit card, or other methods specified in your invoice. Any bank or transaction fees are the sole responsibility of the client.
CURRENCY: Prices are quoted and payable in USD unless otherwise specified. Any fluctuations in exchange rates or additional fees incurred during payment processing are the client's responsibility.
3. Cancellations and Refunds.
CANCELLATION BY CLIENT: All cancellations must be made in writing and are effective upon receipt by Savara Luxe Safari. Cancellation fees are charged as follows:
MORE THAN 60 DAYS BEFORE SAFARI START DATE: 25% of the total safari cost is forfeited.
BETWEEN 31 TO 60 DAYS: 50% of the total safari cost is forfeited.
WITHIN 30 DAYS OR LESS: 100% of the total safari cost is forfeited.
CANCELLATION BY SAVARA LUXE SAFARI: We reserve the right to cancel any safari due to unforeseen circumstances (e.g., force majeure, security concerns).
IN SUCH CASES: Clients will receive a full refund or the option to reschedule the safari at no extra charge. Savara Luxe Safari will not be responsible for additional expenses (e.g., flights, visa fees).
UNUSED SERVICES: No refunds will be provided for unused services (e.g., early departures, missed tours) once the safari has commenced.
4. Travel Insurance.
Comprehensive travel insurance is mandatory for all clients and must include coverage for:
Personal injury, medical expenses, repatriation, cancellation, curtailment, and loss or theft of belongings.
Clients must provide proof of valid insurance before the safari commences. Failure to do so may result in cancellation of the booking with no refund.
5. Health, Safety and Fitness.
HEALTH CONDITIONS: Clients are responsible for ensuring they are physically fit to undertake safari activities. It is the client's responsibility to disclose any medical conditions, disabilities or dietary requirements at the time of booking.
VACCINATIONS AND HEALTH COMPLIANCE: Clients are required to obtain necessary vaccinations and comply with all health regulations for travel to Kenya, Tanzania, Rwanda and Uganda. We recommend consulting a medical professional for up-to-date advice.
SAFTEY GUIDLINES: All clients must adhere to safety instructions provided by our guides. Failure to comply may result in exclusion from activities without refund.
6. Passports, Visas and Travel Documents.
Clients are responsible for ensuring they have a valid passport (with at least six months' validity) and obtaining all necessary visas, permits and other travel documents prior to travel. Savara Luxe Safari will not be held liable for any delays, denied entries or additional costs arising from incomplete or invalid travel documents.
7. Itineraries and Changes.
FLEXIBILITY IN ITINERARY: Safaris operate in remote and unpredictable environments. While we strive to follow the confirmed itinerary, changes may occur due to: (Weather conditions, wildlife movements, park regulations or safety concerns.)
ALTERATIONS BY SAVARA LUXE SAFARI: We reserve the right to make reasonable changes to the itinerary where necessary to ensure an optimal and safe experience. Clients will be notified of significant changes.
ALTERATIONS BY CLIENT: Requests for changes after confirmation may incur additional costs and are subject to availability.
8. Liability and Assumption of Risk.
ASSUMPTION OF RISK: Participation in a safari involves inherent risks, including exposure to wildlife, rough terrain and unpredictable conditions. Clients acknowledge these risks and agree to participate at their own risk.
FORCE MAJEURE: Savara Luxe Safari will not be liable for cancellations, delays, or loss resulting from force majeure events, including but not limited to natural disasters, pandemics, political instability, or travel restrictions.
LIMITATION OF LIABILITY: Our liability is limited to the safari cost paid. We will not be held responsible for any indirect or consequential losses.
9. Complaints and Dispute Resolution.
RAISING A COMPLAINT: Clients must raise any complaints immediately with the safari guide or our local representative for prompt resolution.
FORMAL COMPLAINTS: If the issue is unresolved, a formal written complaint must be submitted within 14 days of the safari's conclusion.
DISPUTE RESOLUTION: Any disputes will first be attempted to resolve through negotiation. If unresolved, they will be settled through mediation or arbitration in Kenya.
10. Governing Law and Jurisdiction.
These Terms and Conditions are governed by the laws of the Republic of Kenya. Any disputes arising under these terms shall fall under the exclusive jurisdiction of the Kenyan courts. Savara Luxe Safari complies with local laws, park regulations, and guidelines in Tanzania, Rwanda, and Uganda where services are delivered.
